PROPERTY ACCESS, BOUNDARIES, AND LIABILITY WAIVER

1. Property Access and Turf Damage: Customer authorizes Gentle Roots Tree Service LLC (the "Company") and its crew members to access the property to perform tree trimming, tree removal, and stump removal services. While the Company does not use heavy machinery, Customer acknowledges that removing heavy wood and running equipment like stump grinders over lawns, flower beds, and paths can cause minor turf compaction, lawn ruts, or minor landscape disturbance. The Company is not responsible for repairing normal wear and tear resulting from standard foot and rigging operations.

2. Property Lines and Ownership Authorization: Customer warrants and represents that all trees and stumps designated for service are located entirely on Customer’s property, or that Customer has obtained explicit, written legal permission from the lawful owner of any neighboring property to perform the requested trimming or felling. Customer agrees to fully indemnify and hold the Company harmless against any third-party claims, lawsuits, or treble damage penalties arising from a dispute over property lines or tree ownership.

3. Underground Utilities & Private Hazards: The Company will contact OHIO811 to locate public utilities prior to any stump grinding. However, Customer is solely responsible for identifying, marking, and notifying the Company of all private underground lines, including but not limited to: irrigation/sprinkler systems, invisible dog fences, landscape lighting wires, septic tanks, and shallow PVC drain pipes. The Company shall not be liable for damage to any private underground systems that were not clearly marked by the Customer prior to the start of work.

4. Stump Removal Limitations: Unless explicitly itemized in writing in the Scope of Work, stump removal is limited strictly to grinding the central stump to a depth of 4 to 6 inches below visible ground level. Surface roots radiating away from the main stump trunk are excluded. All wood chips and grinding debris resulting from the stump removal will be left neatly on-site in the stump hole unless hauling services are explicitly purchased in the work order.

5. Children’s Online Privacy Protection: Our website services are designed strictly for property owners and commercial entities. We do not intentionally target, market to, or collect information from children under the age of 13 in compliance with COPPA rules.

Estimates and Quotes Are Non-Binding: Any online form submission, quote calculator tool, or price estimation feature provided on this Website is intended strictly for preliminary informational purposes. Submitting a request does not create a binding service contract, nor does it guarantee a final price. A legally binding agreement is only formed after an on-site physical property inspection is completed and an Ohio-compliant written contract or work order is signed by both parties.

3. Intellectual Property Protection: All content displayed on this website, including but not limited to text, graphics, business logos, custom code, and before-and-after project photos of tree trimming, tree removal, or stump removal work, is the exclusive property of Gentle Roots Tree Maintenance LLC. Unauthorized duplication, hotlinking, or scraping of our project photos for use on competing commercial websites is strictly prohibited and constitutes copyright infringement.

4. Limitations of Online Liability: While we strive to maintain accurate information on local tree hazards, tree trimming rules, and municipal requirements, the information provided on this Website is for educational purposes only. Gentle Roots Tree Maintenace LLC shall not be liable for any direct, indirect, or incidental digital damages arising from your use of, or inability to use, this Website.

5. Governing Law: These Terms of Service are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal actions must be filed in the courts of Lake County, Ohio.

6. Multi-Day service: Gentle Roots Tree Maintenace LLC endeavors to complete the work in a timely manner but makes no guarantee that a project will be finished in a single day. Work may span multiple days at the discretion of the contractor based on safety, daylight, and job complexity. The customer acknowledges that project completion dates are estimates and that the contractor is not liable for delays caused by inclement weather, equipment failure, or unforeseen site hazards. Equipment and debris may remain on the property overnight during multi-day jobs.
